1. Our Commitment
SendSMS.click is committed to preventing spam and ensuring responsible messaging. We require all users to comply with applicable anti-spam laws including the Unsolicited Electronic Messages Ordinance (UEMO, Cap. 593) in Hong Kong, the TCPA (US), CASL (Canada), and applicable data protection requirements.
2. Definition of Spam
Spam includes unsolicited commercial messages, messages sent without prior consent, messages that do not include required identification or opt-out instructions, and messages sent to recipients who have opted out. We treat all such activity as a serious violation.
3. Requirements for Legitimate Messaging
- Consent: Obtain clear, affirmative consent before sending marketing or promotional messages
- Opt-Out: Include clear opt-out instructions in every message and stop further commercial messages within 10 working days after the unsubscribe request is sent, or sooner if applicable law requires
- Identification: Clearly identify your business or organization in messages
- Honor Opt-Outs: Maintain suppression lists and never contact recipients who have opted out
- Reasonable Frequency: Do not overwhelm recipients with excessive message volume
Hong Kong Messaging Requirements (UEMO)
You must comply with Hong Kong's Unsolicited Electronic Messages Ordinance (UEMO, Cap. 593; 《非應邀電子訊息條例》) and its subsidiary regulation when sending commercial electronic messages with a Hong Kong link. In particular, you must:
- Identify the sender: Include clear and accurate sender information, including the sender's name, contact telephone number, and business address. For SMS, the address may be omitted only if recipients can obtain it by calling the contact telephone number provided.
- Provide an unsubscribe facility: Include a working unsubscribe facility and clear instructions in every commercial message. For SMS, provide at least a Hong Kong telephone number that accepts unsubscribe requests orally or by key input.
- Honour unsubscribe requests: Stop sending further commercial messages to the relevant number within 10 working days after the unsubscribe request is sent. Maintain an up-to-date suppression list and check it before every send.
- Screen the Do-not-call Registers (拒收訊息登記冊): Check recipient numbers against the applicable register before sending. As a condition of using this Service, you must not send commercial messages to numbers listed on that register.
You are responsible for your message content, sender information, unsubscribe handling, and recipient-list screening. These requirements apply to campaigns and messages sent through the API.
For the statutory requirements, see the Office of the Communications Authority's UEMO guidance. Our prohibition on sending to registered numbers is a condition of using the Service.
4. Compliance and Monitoring
We monitor message patterns, complaint rates, and carrier feedback. Accounts with elevated complaint rates or suspicious activity may be suspended. We may require proof of consent. Persistent violators will be terminated and reported to carriers.
5. Reporting Spam
If you receive spam that appears to originate from our platform, please report it to [email protected]. Include the message content, sender, and timestamp. For general inquiries, contact [email protected].
